Environmental Compliance/Insurance Coverage:

Represented a heating oil company to assist with a multi-million dollar remediation of its bulk oil facility and the adjacent public roadway impacted off-site migration of contamination. Provided oversight to the environmental consultant and remediation contractors. Interfaced with the municipality for the off-site remedial work and multiple insurance carriers to get 100% coverage for all facets of the remediation which was negotiated to bring the property up to residential cleanup standards.

Environmental Compliance/Property Casualty Claim:

Represented a residential condominium owner in a property casualty claim for black water flooding of the unit’s basement and ground floor due to damage to the main sewer line to the unit. Successfully negotiated with both the client’s and the condominium association’s carriers for 100% recovery of claimed damages. Provided significant oversight for proper documentation of incurred damages as well as necessary remedial actions and alternative living expenses to address an emergent health exposure.

Environmental Compliance/Permitting:

Assisted client in obtaining the State’s first Research and Development Permit under the State’s Hazardous and Solid Waste Permitting program for on-site magnetic recovery of non-ferrous metals from deposited waste at a county solid waste landfill. This resource extraction operation preserves a valuable state resource – landfill space.

Real Estate Litigation:

Settlement of a quiet title action against contract purchaser of 422-acre farm presenting $1.7 million contract with an 85-year-old widow for property appraised at $5.575 million. Client prosecuted claims of undue influence against purchaser. Settlement resulted in client retaining title to the property with purchaser getting limited future purchase option at fair market value. Settlement achieved after 10 days of trial and testimony from 18 witnesses.

Real Estate Litigation/Environmental:

Settlement of successive year property tax appeals for a laboratory facility with assessments reduced 30% for both years based on a highest and best use analysis and consideration of environmental and other physical conditions of the property. The settlement was achieved without an appraisal.
